USAGE POLICY

Contract for Photo Usage Rights Granted: By accepting, downloading, and/or using the photographs you agree to the following terms of usage and payment in full before any usage: 

License and Usage for the agent on the order sheet and their company only.

Photographs are for the sole purpose of marketing the photographed property for sale. Usage rights expire when the sale completes, or when the agent’s contract ends with the seller. Photos and video are non-transferable. Agents may use the photos on their websites after the property is sold by them and for promotional materials to market themselves. 

Photographs may not be distributed to construction contractors, finishers, architects, developers, designers, builders, stagers, or other parties for the promotion of their businesses or for their personal use. If any parties, or the homeowner request copies of the photographs please have them contact Teri Fotheringham, teri@denverphoto.com to plan and pay for a separate licensing and usage fee.

Federal Jurisdiction: Client hereby expressly consents to the jurisdiction of the Federal courts with respect to claims by TeriFotheringham Photography under the Copyright Act of 1976, as amended, including subsidiary and related claims. Photographs and videos are the sole property of Teri Fotheringham Photography and she retains the copyright always. It is a violation of the realtor code of ethics to sell or give photos to other agents or anyone wishing to further their business’ advertising or marketing.

 CANCELLATION POLICY

Assignment Cancellations and Postponements: Cancellations: Client/representative, if notice of cancellation is given less than 24 hours before the scheduled shoot, client is responsible for the full cancellation fee of $250.00. Postponements: Unless otherwise agreed in writing, Client will be charged a 100% fee if postponement of the shoot occurs after photographer has departed for location, or the property is not ready to photograph upon arrival. Weather postponements are negotiated between photographer and agent and usually do not incur additional fees.

By accepting, you are the agent on the order sheet, or you have authority to send the order sheet by the company and are agreeing to all terms for the parent company. You are responsible for making the agent aware that they have agreed to the terms and will be responsible for any breach of contract.
